Tesla and Mercedes both currently allow some touchscreen video games to run on screen while driving; only one manufacturer considers it an oversight.

Mercedes is recalling vehicles due to the safety concern, but Tesla is moving full steam ahead to continue offering gaming technology in vehicles.

"We are aware of driver concerns and are discussing the feature with the manufacturer,” the National Highway Traffic Safety Administration said regarding Tesla, according to Car and Driver. “The Vehicle Safety Act prohibits manufacturers from selling vehicles with design defects posing unreasonable risks to safety.” Tesla has remained silent on the issue so far.

Mercedes is recalling 227 vehicles due to a malfunction with the TV, digital owner’s manual and video games that could distract the driver.

It issued a recall for four models: the 2021 S580, the 2022 EQS450, EQS 580 and S500.

Tesla is still allowing video games to run while the vehicle is in motion, even though the technology does not have the capacity to distinguish whether the driver or passenger is playing.
